Welcome to the Montjoy App (the “App”) and the website www.montjoyapp.com (the “Site”), which are owned and operated by Montjoy, Inc. (“Montjoy,” “we,” “us,” or “our”).

These Terms of Use (“Terms”) govern your access to and use of our Site, App, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. User Accounts and Security

  • Eligibility: You must be at least 13 years of age to use the Service.

4. User-Generated Content

  • Your Rights: You retain all ownership rights to the content (photos, text, location data) you submit to the Service.

  • Our License: By submitting content, you grant Montjoy, Inc. a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, display, reproduce, and distribute your content in connection with operating and providing the Service.

  • Responsibility: You represent and warrant that you own or have the necessary licenses and permissions to share the content you post.

5. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Montjoy, Inc. Our trademarks, logos, and trade dress may not be used in connection with any product or service without the prior written consent of Montjoy, Inc.

6. Mobile Messaging (SMS)

By providing your mobile phone number and opting in, you agree to receive text/SMS messages from Montjoy, Inc.

  • Frequency: Message frequency may vary.

  • Costs: Standard message and data rates may apply.

  • Opt-Out: You may opt-out at any time by texting "STOP." For help, text "HELP."

7. Limitation of Liability

To the maximum extent permitted by applicable law, Montjoy, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

8. Indemnification

You agree to defend, indemnify, and hold harmless Montjoy, Inc. and its employees, contractors, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Service or your violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within Gwinnett County, Georgia for the purpose of litigating all such claims or disputes.
